Picture this: You are scrolling through a property website and you spot it—a stunning, fully-furnished sea-view penthouse in Phuket. It’s significantly cheaper than the new off-plan project next door, and it’s ready to move in today.

You think, “Perfect! I’ll buy this for 12 Million Baht, move in, and get that 10-Year Visa I read about.”

Stop right there.

If you are buying a “second-hand” (resale) condo with the specific goal of obtaining the 10 Million Baht Investment Visa, you might be walking into a bureaucratic trap.

At Sukhothai Inter Law, we often rescue investors who signed a contract before checking the immigration rules. Today, we are clearing up the confusion: Can you really use a resale condo for the Thailand Investment Visa in 2026?

The General Rule: Immigration Loves “New Money”

To understand the answer, you have to understand the logic of the Thai Immigration Bureau. The Investment Visa (Non-Immigrant IB) was designed to stimulate the Thai economy by bringing new foreign currency into the construction and development sectors.

Because of this, the “Golden Path” for this visa has always been buying a new unit directly from a developer.

Why? Because it’s clean.

  1. Valuation is Clear: The purchase price usually matches the official appraisal.

  2. FET Form is Easy: The developer helps you get the Foreign Exchange Transaction (FET) form, proving 100% of the funds came from abroad.

The Problem with Resale Condos

Technically, the law says you must “invest in the purchase of a condominium unit.” It doesn’t explicitly write “NO SECOND HAND” in red ink. However, in practice, using a resale condo for the investment visa is fraught with three major risks that often lead to rejection.

Risk 1: The “Payment Abroad” Trap

Most foreigners selling their Thai condos want the money sent to their home country (e.g., the UK, Singapore, or Hong Kong).

  • The Visa Rule: To get the Investment Visa, you must transfer foreign currency into Thailand.

  • The Conflict: If you pay the seller directly in their overseas account, no money enters Thailand. No FET form is issued. Result: No Visa.

Risk 2: The Valuation Gap

Immigration calculates your investment based on the official government appraisal value, not necessarily the market price you paid.

  • Scenario: You buy a luxury resale condo for 12 Million Baht (Market Price).

  • Reality Check: The Land Department’s official appraisal for that older building is only 8 Million Baht.

  • The Verdict: You are 2 Million Baht short of the 10 Million Baht requirement. You would need to top this up with a Fixed Deposit, tying up more cash.

Risk 3: The “Benefit to Economy” Argument

Immigration officers have wide discretion. Some officers interpret the law to mean “Investment that drives new economic activity.” Buying a condo from “John in London” doesn’t stimulate the Thai construction sector. We have seen applications delayed or rejected on these grounds unless the paperwork is bulletproof.

So, Is It Impossible?

Not impossible, but highly complex. To make a resale condo work for the 10M Investment Visa, you must:

  1. Transfer the full purchase price in foreign currency into Thailand (to the seller’s Thai bank account).

  2. Obtain the FET form from the receiving Thai bank.

  3. Ensure the Assessed Value (not just purchase price) meets the 10M threshold (or be ready to top up with Cash/Bonds).

The Better Alternative for 2026: The LTR Visa

If you have your heart set on a specific resale property, don’t force the 10M Investment Visa. Look at the Long-Term Resident (LTR) Visa instead.

The LTR “Wealthy Pensioner” or “Wealthy Global Citizen” tracks allow for investment in Thai property (approx. $250,000 – $500,000 USD). Crucially, the LTR rules are often more flexible regarding the type of property investment compared to the rigid old-school Investment Visa, provided your overall asset and income profile is strong.

Don’t Sign the Deposit Yet

Buying a second-hand condo is a great lifestyle choice, but a risky immigration strategy if you don’t have a lawyer.

Do not rely on the seller’s agent to tell you the truth about visas. They want the commission; we want you to stay in Thailand legally.
